Terms of Service

Sitethreesixty is a trading name of Your Home Tech Guy Ltd, a company registered in England and Wales under company number 16884983, with its registered office at 108 Glebelands Rd, Sale, Cheshire M33 6JR, United Kingdom.
We also operate through a separate legal entity in the United States: Sitethreesixty LLC, located at 473 NE 38th St, Boca Raton, FL 33431, USA.
These Terms of Service (“Terms”) govern your access to and use of our website and the website management, hosting, SEO, booking systems, payment integration, support, and related subscription services we provide (collectively, the “Services”).
By accessing our website, requesting a quote, or purchasing or using our Services, you agree to these Terms. If you do not agree, you must not use our Services.
1. Who We Are and How to Contact Us
- Primary data controller for UK GDPR purposes: Your Home Tech Guy Ltd (trading as Sitethreesixty).
- Our full Privacy Policy, which explains how we collect, use, and protect personal data (including international transfers between our UK and US entities under a UK International Data Transfer Agreement), is available here.

2. B2B Customers (Primary Focus)
These Terms are written for business-to-business (B2B) transactions. If you are purchasing as a business or in the course of a trade, business, or profession, you acknowledge that:
- Statutory UK consumer rights (including the 14-day cooling-off period under the Consumer Contracts Regulations) do not apply to you.
- Services may commence immediately upon acceptance of a quote or proposal.
- You are responsible for all setup fees, subscription charges, and any additional work in accordance with the accepted quote and these Terms.
- Cancellation, early termination, refunds, and suspension are governed solely by the provisions in these Terms.
By proceeding, you confirm you are acting in the course of business.
Note for UK Consumers (if applicable): If you are a UK consumer (acting wholly or mainly outside any trade, business, or profession), you have a statutory 14-day cooling-off right. Where you request that work begins immediately, you may be charged a reasonable amount for any services already provided. See section 6 below.
3. Pricing & Promotions
All prices are subject to availability and may be changed with reasonable notice.
Monthly subscription fees are subject to change, but we will notify you in advance.
Prices are shown exclusive of applicable taxes (VAT where applicable, or US sales tax) unless otherwise stated.
Promotional offers (including setup-fee waivers and the 360 Charter Rate Guarantee) cannot be combined unless expressly stated and are subject to the specific terms in section 13 and elsewhere.
4. Subscription Term & Renewal
Subscriptions run on a 30-day rolling basis.
After any initial period, the subscription automatically renews every 30 days unless cancelled in accordance with these Terms.
Cancellation takes effect at the end of the current billing period. No refunds are given for partially used periods unless required by law.
5. Setup, Onboarding & Website Build Services
Setup, onboarding, and initial website build are one-time services.
Standard setup fees (subject to your quote):
- US: $195 (360 Lite) / $325 (360 Pro)
- UK: £150 (360 Lite) / £250 (360 Pro)
Under launch promotions, the setup fee may be waived or discounted provided the subscription remains active for a minimum of four (4) consecutive months with no break in service.
If you cancel before the four-month period, the full applicable setup fee becomes immediately payable.
Additional work beyond the standard scope is charged at:
- US: $120 per hour
- UK: £90 per hour
Full details are provided in your written quote or proposal, which you must accept before work begins.
6. Early Cancellation & Work Already Performed
If you cancel after work has started, you remain liable for:
- Any setup fees that become payable under the promotion rules.
- All additional or completed work up to the cancellation date.
No automatic refund is provided for services already delivered.
UK Consumer Cooling-Off Rights (if you are a consumer): You may cancel within 14 days of contract formation. If you requested immediate commencement of services, we may charge a reasonable sum for work already carried out. This is in addition to (and does not limit) your rights under these Terms.
7. Quotes & Acceptance
All Services are provided on the basis of a written quote or proposal.
By accepting a quote (via email, portal, payment, or other clear indication), you confirm you have read, understood, and agree to:

- The specific pricing, setup conditions, and scope in the quote
- Our Privacy Policy and Acceptable Use Policy
8. Service Scope & Fair Use
Our subscription plans cover the features and support levels described in your chosen plan.
Excessive, unreasonable, or out-of-scope requests may incur additional charges or require a revised quote, which we will discuss with you in advance.
We reserve the right to refuse or suspend Services that are unlawful, abusive, or materially impact the security or performance of our systems or other clients.
9. Changes to Services
We may update or modify the Services for security, performance, or functionality improvements.
If a change materially and adversely affects your subscription, we will give you reasonable notice.
10. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of profits, data, business, goodwill, or anticipated savings.
- Our total aggregate liability to you for any claim arising out of or in connection with these Terms or the Services shall not exceed the total amount you have paid to us in the 12 months immediately preceding the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.
11. Termination for Cause
We may suspend or terminate the Services immediately if:
- You fail to pay any amount due
- You materially breach these Terms
- You use the Services unlawfully or abusively
Where reasonably possible, we will give notice and an opportunity to remedy the issue.
12. Governing Law & Jurisdiction
- For customers contracting with Your Home Tech Guy Ltd (UK): These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
- For customers contracting with Sitethreesixty LLC (US): These Terms are governed by the laws of the State of Florida (or the applicable U.S. state), without regard to conflict-of-law principles.
We will determine which entity you are contracting with based on your location, billing address, and the quote provided.
13. 360 Charter Rate Guarantee Promotion
Eligibility
The 360 Charter Rate Guarantee promotion is a limited availability launch offer. Once all spots are filled, this offer is permanently closed and will not be repeated.
Pricing & Inflation Protection
360 Charter Rate Guarantee members receive a discounted monthly rate locked in from day one. Rates will never increase beyond the average annual inflation rate as published by the Office for National Statistics (ONS) for UK clients or the Bureau of Labor Statistics (BLS) for US clients.
Third-Party Services Exclusion
Services that rely on third-party providers — such as email delivery, AI-powered features, and SMS — are subject to the pricing set by those providers and are not covered by the 360 Charter Rate Guarantee inflation guarantee.
Continuous Management Requirement
360 Charter Rate Guarantee status requires continuous management. If a client leaves Sitethreesixty management and returns, they will return at standard rates without the inflation guarantee.
Payment Lapse Policy
- Days 1–14: Grace period — site stays live, payment reminders sent
- Day 15: Site taken offline
- Day 31: Considered a break in the 30-day rolling contract — 360 Charter Rate Guarantee discount and inflation guarantee are permanently lost
- Day 61: Site archived for up to 1 year, then permanently removed
Plan Switching
360 Charter Rate Guarantee members may switch between 360 Lite and 360 Pro without losing their 360 Charter Rate Guarantee status or inflation guarantee.
Taxes & Statutory Charges
UK: Sitethreesixty is not currently VAT registered. Prices do not include VAT. If Sitethreesixty becomes VAT registered in the future, VAT will be applied to all invoices at the prevailing rate as required by law. This is a statutory obligation and is separate from any pricing guarantees.
US: All prices are exclusive of applicable sales tax (Florida state + county surtax). Sales tax is applied at checkout.
14. SMS Service — Pricing & Fair Use
SMS confirmations and reminders are available on the 360 Pro plan. Pricing is as follows:
- UK: 6p per text message — first 50 messages per month are free
- USA: $0.08 per text message — first 50 messages per month are free
SMS costs beyond the free allowance will be itemised on your monthly invoice.
15. SMS T&C — USA Clients Only
Sender Identification
The Client acknowledges and agrees that all SMS messages sent through the Service are sent on behalf of the Client, and that the Client is the sole “sender” and “originator” of such messages for purposes of applicable U.S. laws and carrier regulations, including the Telephone Consumer Protection Act (TCPA).
Compliance Warranty
The Client represents and warrants that it has obtained all necessary consents, permissions, and authorisations required under applicable U.S. federal, state, and local laws to send SMS messages to recipients, including but not limited to the TCPA, and that all messages sent through the Service comply with carrier policies and messaging regulations.
Permitted Use
The SMS Service is provided solely for transactional and informational communications, including but not limited to appointment reminders, service notifications, security alerts, and account-related messages.
The Client shall not use the Service to send promotional, marketing, advertising, or sales messages unless expressly authorised in writing and subject to additional compliance requirements.
Content Restrictions
Transactional messages must not contain marketing language, promotional offers, discounts, calls to purchase, or any content reasonably construed as advertising.
Opt-Out Requirements
The Client acknowledges that all SMS messages must support standard opt-out keywords, including but not limited to “STOP,” “UNSUBSCRIBE,” or “CANCEL,” and that recipients who opt out must not receive further messages unless legally permitted.
Permitted Sending Hours
The Client agrees that SMS messages shall only be sent between 8:00 a.m. and 9:00 p.m. local time of the message recipient, unless otherwise permitted by law.
A2P Registration
The Client agrees to provide accurate and complete business information, including a valid U.S. Employer Identification Number (EIN), for purposes of registering the Client’s messaging brand and campaign with U.S. mobile carriers and applicable registries.
The Client acknowledges that failure to provide accurate information may result in message filtering, suspension, or termination of the SMS Service.
Suspension Rights
We reserve the right to immediately suspend or terminate SMS services, without prior notice, if we reasonably believe that the Service is being used in violation of applicable laws, carrier policies, or these Terms, or in a manner that exposes us to legal or regulatory risk.
Indemnification
The Client agrees to indemnify, defend, and hold harmless Sitethreesixty, its officers, directors, employees, and agents from and against any and all claims, damages, penalties, fines, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to the Client’s use of the SMS Service, including any alleged violation of the TCPA or carrier messaging rules.
Message Templates
We may require pre-approval of message templates and reserve the right to restrict or modify message content to ensure compliance with applicable laws and carrier requirements.
TCPA Penalties
These terms are governed by the Telephone Consumer Protection Act 47 U.S.C. § 227. Breach of any of these terms may result in:
- $500 per message in statutory damages
- $1,500 per message if the violation is deemed willful
- Class action lawsuit exposure
16. General Provisions
- Entire Agreement: These Terms, together with the accepted quote, Privacy Policy, and Acceptable Use Policy, constitute the entire agreement between you and us.
- Severability: If any provision is held invalid, the remainder remains in full force.
- No Waiver: Failure to enforce a right does not constitute a waiver.
- Changes to These Terms: We may update these Terms. Continued use after changes constitutes acceptance. We will post the new “Last updated” date at the top.
- Third-Party Services: Many features rely on third parties (e.g. Stripe, Cloudflare, email providers). You are subject to their terms where applicable.
